The Melbourne, Australia inner-city suburbs of Richmond and Abbotsford are locations in which the use and dealing of heroin has been concentrated for a protracted time period. Research organisation the Burnet Institute completed the 2013 'North Richmond Public Injecting Impact Study' in collaboration with the Yarra Drug and Health Forum, City of Yarra and North Richmond Community Health Centre and recommended 24-hour access to sterile injecting equipment due to the ongoing "widespread, frequent and highly visible" nature of illicit drug use in the areas. During the period between 2010 and 2012 a four-fold increase in the levels of inappropriately discarded injecting equipment was documented for the two suburbs. In the local government area the City of Yarra, of which Richmond and Abbotsford are parts of, 1550 syringes were collected each month from public syringe disposal bins in 2012. Furthermore, ambulance callouts for heroin overdoses were 1.5 times higher than for other Melbourne areas in the period between 2011 and 2012 (a total of 336 overdoses), and drug-related arrests in North Richmond were also three times higher than the state average. The Burnet Institute's researchers interviewed health workers, residents and local traders, in addition to observing the drug scene in the most frequented North Richmond public injecting locations.

First, Article 102 of the Treaty on the Functioning of the European Union prohibits "abuse by one or more undertakings of a dominant position". A "dominant position" is presumed to exist with over a 50% market share, and may exist with a 39.7% market share. There may also be dominance through control of data, or by a group of undertakings acting collectively, and a corporate group will be treated as a "single economic unit" for the purpose of calculating market share. The prohibited categories of "abuse" are unlimited, but article 102 explicitly spells out the bans on (a) "unfair purchase or selling prices", (b) "limiting production", (c) "applying dissimilar conditions to equivalent transactions", and (d) imposing unconnected "supplementary obligations" to contracts. In a leading case on (a) unfair prices, United Brands Co v Commission held that, although a banana company had a dominant position in its product and geographic markets (because bananas were not easily substituted with other fruit, and its relevant market share was 40 to 45%), prices 7% higher than rivals were not enough to be an abuse. By contrast prices 25% higher than a company's estimated costs were found to be unfair. Unfair pricing also includes predatory pricing, where a company cuts its own selling prices to bankrupt a competitor: there is a presumption of abuse if a company prices "below average variable costs", namely "those which vary depending on the quantities produced". There is no requirement to show losses might be recouped.

Social behavior can be seen as similar to an exchange of goods, with the expectation that when one gives, one will receive the same. Acute Toxicity Solid-Phase Test is a procedure that allows the test organism to come in direct contact with the solid sample as particulate in an aqueous suspension. Normally, this test provides results indicating equal or higher toxicity when compared to eluate or pore water tests of the same sample. This is due to either equal or increased bioavailability resulting from direct contact. This test is subject to several sources of interference of luminescence including loss of bacteria from effects other than toxicity such as filtration of the sample; absorption of light due to color; and scattering of light due to turbidity. Corrections can be made by testing a sample of similar particle composition that is known to not be toxic. This test consists of two controls and 13 sample dilutions in duplicate. The Solid-Phase Test exposes the bacteria in such a way that is not always possible with pore water and elutriate. Acute Toxicity Comparison & Inhibition Tests are the best procedures for testing samples with a low level of toxicity when an ECxx can not be determined using the Basic Test. These protocols are recommended for testing waste water treatment plant effluent, stormwater runoff, drinking water, pore water, and eluate. These tests use multiple replicates of a sample at a single concentration. Similar to the Basic Test, the Comparison Test protocol uses zero time light readings used for correcting the timed light level readings.
